Hament may suspend or terminate your access to the platform at any time—without prior notice—if you breach these Terms, violate any applicable law or internal policy (including AML/KYC requirements), supply false information, or engage in activity that threatens other clients, our systems, or our regulatory standing. All rights granted to you under these Terms will immediately cease upon such termination.
If your account is closed, any open orders are cancelled and remaining assets are moved—subject to settlement cycles and regulatory holds—either to a verified external account you designate or to a segregated custodian account in your name. You remain liable for all fees, charges, and taxes incurred before the termination date, and provisions covering intellectual-property rights, liability limits, indemnities, and governing law will continue to apply.
To open and maintain a Hament account, you must be at least 18 years old and legally permitted to invest where you reside; you agree to provide accurate, up-to-date information and to complete all KYC/AML checks under Tanzanian, U.S., and Cayman regulations, keep your login and MFA credentials secure (reporting any compromise to hello@hamentgroup.com), and understand that all instructions sent with those credentials are treated as authorised by you; we may classify you as Retail, Professional, or Institutional (affecting product access and disclosures) and, if no login occurs for 12 months, may mark the account inactive and require re-verification before reactivation..
Your access to the Hament platform is a revocable, non-exclusive, non-transferable licence strictly for personal or internal business use in evaluating, executing, and monitoring investments. You agree to use the site and its APIs only through interfaces we provide, to follow all instructions published in our user guides, and to comply with applicable securities laws, exchange rules, and data-provider restrictions..
You must not resell, distribute, copy, reverse-engineer, or otherwise exploit any part of the platform; introduce malware, bots, or automated scraping tools; or attempt to gain unauthorised access to our servers or to the accounts of other clients. Any breach of these usage conditions may result in immediate suspension or termination of access and could expose you to civil or criminal liability under relevant Tanzanian, U.S., or Cayman Islands law.
All trading commissions, custody fees, platform subscriptions, foreign-exchange spreads, and any other charges applicable to your account are displayed in the Fees & Charges Schedule and debited in the settlement currency you select at onboarding (USD by default). Unless otherwise stated, fees accrue at the time a transaction is executed or a service is rendered, and they are automatically swept from your available cash balance on the next business day. If sufficient cash is not available, we may liquidate positions without prior notice to cover outstanding amounts..
Monthly or annual subscription fees—for data packages, premium analytics, or managed-portfolio mandates—are billed in advance on the 1st calendar day of each billing period. You authorise Hament (or its designated payment processor) to charge the payment method on file, and you remain responsible for any bank charges, withholding taxes, or currency-conversion costs. If a payment fails, we will notify you by email and may suspend access to the affected services after five (5) business days; interest at 1 % per month (or the maximum rate permitted by law, if lower) applies on overdue balances until paid in full.
Hament collects and processes your personal and financial information solely to provide regulated investment services, in line with the Tanzania Personal Data Protection Act, the U.S. Gramm-Leach-Bliley Act, Cayman Islands Data Protection Act, and (where applicable) the EU/UK GDPR. All client data are encrypted in transit (TLS 1.3) and at rest (AES-256), stored in tier-one cloud facilities with ISO 27001 and SOC 2 Type II certifications, and accessible only to staff who require it for compliance or servicing purposes under multilayer role-based controls and mandatory MFA. We never sell or rent your data; third-party vendors (e.g., custodians, KYC providers, analytics tools) receive only the minimum information necessary and must contractually meet equivalent security and confidentiality standards. You may request access, correction, or deletion of your data at any time by emailing hello@hamentgroup.com, and we will retain records only for as long as laws and regulatory obligations require.
All platform software, source code, algorithms, user-interface elements, market data feeds, reports, logos, trademarks, and all other content displayed on or generated by the Hament platform (collectively, “Intellectual Property”) are owned by Hament Inc. or its licensors and are protected under U.S., Tanzanian, Cayman Islands, and international copyright, trademark, and database-rights laws; you receive only a limited, revocable licence to access and use this Intellectual Property for personal or internal business purposes in connection with lawful investment activity, and you may not reproduce, distribute, modify, reverse-engineer, scrape, or create derivative works without our prior written consent—any unauthorised use automatically terminates your licence and may subject you to civil or criminal liability, while all goodwill arising from permitted use of Hament trademarks inures solely to Hament..
You may cancel any recurring subscription—whether for premium data packages, managed-portfolio mandates, or platform add-ons—by submitting a written request through your secure client portal or emailing hello@hamentgroup.com at least three (3) business days before the next billing cycle; cancellations take effect at the end of the current paid period, after which no further charges will accrue, and access to the cancelled service tier will cease. One-time transaction fees already incurred (e.g., trade commissions, wire-transfer charges) are non-refundable, and any outstanding balances must be settled in full prior to closure. In the rare event Hament discontinues a service, we will provide at least 30 days’ notice and refund any prepaid, unused portion on a pro rata basis to your default settlement account.
